Terms & Conditions

Horsefly (“we”, “us”, “our”) is a marketing content sampling tool. By accessing or using the Horsefly platform (“Service”) you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

You must be at least 18 years old and have the legal capacity to enter into binding contracts in your jurisdiction to use the Service. By using the Service you represent that you meet these requirements.

Horsefly automates the process of subscribing a supplied email address and/or phone number to third-party marketing lists so that you can receive, review, and rank marketing content at scale. You acknowledge that:

• Third-party websites are outside our control and their terms govern how your data is used on those platforms.
• The volume and nature of marketing communications you receive depends on the tier you select and the behaviour of third-party senders.
• We do not guarantee that any particular site will accept your subscription or that sign-up attempts will succeed.

You agree not to:

• Use the Service to sign up email addresses or phone numbers that you do not own or have explicit permission to use.
• Use the Service to harass, spam, or harm any individual or organisation.
• Attempt to reverse-engineer, scrape, or exploit the Service in a way that places unreasonable load on our infrastructure.
• Use the Service in violation of any applicable law or regulation, including but not limited to GDPR, PECR, CAN-SPAM, and CASL.

The Service is offered on a tiered subscription basis as described on the Features page. Prices are stated in GBP and are inclusive of any applicable VAT. Payments are processed by our third-party payment provider. We reserve the right to change pricing with reasonable notice. Subscriptions renew automatically unless cancelled before the renewal date.

All software, designs, and content comprising the Horsefly platform are our exclusive property or are licensed to us. Nothing in these Terms grants you any right to copy, distribute, or create derivative works from the platform itself. Marketing content you receive via the Service belongs to its respective senders.

The Service is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the amount paid by you to us in the twelve months preceding the claim.

You agree to indemnify and hold harmless Horsefly and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice where practicable. You may cancel your subscription at any time via your account settings. Upon termination, your right to use the Service ceases immediately.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. We will notify you of material changes by posting an updated version with a new effective date. Continued use of the Service after any changes constitutes acceptance of the revised Terms.
